Terms of Service

1. Acceptance

By creating an account or using SMBeast Mode (the "Service"), operated by Portfolio Leverage Co. ("we", "us", "our"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What the Service does

SMBeast Mode runs a daily AI-generated executive briefing for your business. It connects to third-party tools you authorize (e.g. Stripe, HubSpot, QuickBooks, Slack, Google Calendar, Notion), summarizes that data with AI models from Anthropic and OpenAI, and delivers a written and voice brief to you and your team.

3. AI output disclaimer

Briefs are produced by large language models. Output can be incomplete, inaccurate, or misleading. You are responsible for verifying any AI output before acting on it. We make no warranty that briefs are correct, complete, or fit for any particular purpose. Briefs are not financial, legal, tax, medical, or HR advice.

4. Your account and data

You agree to keep your credentials secure and notify us immediately of any unauthorized access. You retain ownership of the data you upload or connect. You grant us a limited license to process that data solely to operate the Service for you. We do not sell your data. We do not use your private workspace data to train third-party models.

5. Acceptable use

You will not (a) reverse engineer the Service, (b) use the Service to violate any law or third-party right, (c) attempt to extract our proprietary prompts or model behavior, (d) probe, scan, or test the vulnerability of any system, (e) use the Service to send spam or harassment, or (f) resell the Service without written consent.

6. Subscription and billing

Paid plans are billed in advance on a monthly or annual cycle through Stripe. Subscriptions renew automatically until canceled. You can cancel anytime from your billing portal. See our Refund Policy.

7. Service availability

We aim for high availability but make no uptime guarantee. We may modify, suspend, or discontinue any feature at any time. We are not liable for downtime caused by third-party providers (Anthropic, OpenAI, Stripe, Clerk, Neon, Resend, Inngest, Vercel, or your connected integrations).

8. Termination

We may suspend or terminate your account for breach of these terms, non-payment, fraud, or abuse. You may delete your account at any time from the dashboard. On termination, we will delete your data within 30 days unless retention is required by law.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of the Service will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim, or (b) US $100. We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Wilmington, Delaware.

11. Changes

We may update these terms. Material changes will be announced in-app or by email. Continued use after the effective date constitutes acceptance.
